Municipality Abatement Program
The program grew out of an early 1990's lead abatement
program sponsored for HUD grantees by the Highpoint
Housing Authority in North Carolina. It provided
pollutant specific coverage, as opposed to full pollution
for the contractors and unit owners for abatement
being done with a HUD grant. Since
it's inception the program in 1991, abatement coverage
has become freely available and virtually all licensed
abatement contractors have a policy form that includes
broad spectrum pollution.
Yet
federal guidelines have not changed which recommends
that grantees purchase the insurance. In fact grantees
are allowed to report the cost in the grant. The main
reason for this is the grantee is insured , along with
the unit owner (if different from the grantee), and
the contractor.
Policy:
There is a modified contractor’s pollution
liability policy. It provides occurrence coverage
to give completed operations for up to one year after
the policy expires on jobs completed during the policy
period. The policy may be written on a stand alone
pollution policy or it may include General Liability.
Only named pollutants are covered. (i.e.: Lead, Asbestos, PCB's etc.). Defense
cost is outside the limit.
The policy is written to run concurrent with the grant, and therefore is usually
multiple years, but the aggregate limit is for the policy term, not an annual
aggregate per ISO language are available, for an additional charge of 10%.
It is common to have the policy period to read: from x/x/00 - x/x/00, or until
100 units are abated under Grant number XXXX, which ever occurs first.

Secured Creditor
The Secured Creditor/Bankers Environmental Risk
Property Insurance Program protects lenders against
loss from borrower default on a commercial real estate
loan that is secured by an insured property, leasehold
or fixed assets. If there is a default caused by
a pollution condition on the insured property, the
policy will indemnify the lender for the outstanding
loan balance.
Additionally,
the policy will provide coverage for the lender against
third-party claims for bodily injury, property damage
or cleanup costs resulting from pollution conditions
on the property. As risk protection is provided to
both lender and borrower, transactions can be completed
confidently and efficiently. A lender's entire portfolio
of loans can be insured with this policy.
